Divorce Packages

You have to be married for at least one year before you can commence divorce proceedings and you and your spouse must be living in England or Wales when the divorce petition is sent to the Court. Please note that irrespective of which tier you utilise, the following current court fees are payable: -

1. £300.00 - For presenting a divorce petition to the Court – this starts the divorce proceedings.

2. £40.00 - Application for Decree Absolute – this is the document that confirms you are divorced. 

3. If your circumstances are such that you have a low income, you may be entitled to be exempt from the Court fee, which is listed as one of the forms available under tier One.

  • Affidavit in support of the petition based on 5 years separation without consent
  • Affidavit in support of the petition for 2 years desertion

Issue Divorce
To proceed with a divorce you must satisfy the one ground for divorce which is that the marriage has broken down irretrievably and you must base that ground on one or more of five facts: -

a)  Adultery – Your spouse has committed adultery and you find it intolerable to continue to live with your spouse.

b)  Unreasonable Behaviour – Your spouse has behaved in such a way that you perceive to be unreasonable and as a result you find it intolerable to live together.

c)  Desertion - Your spouse has deserted you on a permanent basis for 2 years or more. This is a difficult ground to prove and may be easier to utilise ground b above.

d)  Two years separation with consent – You have been separated for a period of 2 years and your spouse consents to the divorce (Please note that such consent can be withdrawn so it is imperative that you and your spouse agree to this)

e)  Five years separation without consent – If you have been separated for a period of 5 years then you do not require the consent of your spouse to commence divorce proceedings on this basis.

Please note that once this petition is ready to be sent to the Court there is a Court fee of £300.00 for submission of the petition to the Court.
